Since the beginning of the 1950's, the European Community has dealt with the protection of basic human rights and freedoms of which an integral part is the care of complying with the principles of equal handling and fighting against all forms of discrimination. A similar process started with necessary intensity in our territory after 1989 and accelerated when the Czech Republic joined the European Union in 2004; despite of this, many respondents of sociological researches are sure of a high rate of discrimination. The authors have used a comparative analysis to compare the data on discrimination gained from research on public opinion with the exact data on discrimination gained by the Public Defender of Rights as the responsible authority, namely particular individuals who feel that particular situations as discrimination were examined. The subjective opinion of the respondents of sociological surveys who present their opinion on discrimination but have never faced it markedly differ in many aspects from the data gained by the protector of public rights during the examination of particular complaints; however, these basically agree with the knowledge of the respondents having personal experience with discrimination. The title of the paper came from that because of the existence of two – in our opinion – long-term and unreasonable views of discrimination in the Czech Republic that are presented independently. We consider the first view real and right, because it is supported by the results of research performed by the professional staff of the Public Defender of Rights. Despite the possible protest of some readers we understand the second view as a laic one, established in the general public and sure of the high rate of various discrimination in the Czech society. It is a laic view because the sociological research – although of course carried out and elaborated by renowned companies – includes views of discrimination of the respondents who do not have personal experience with discrimination in 90% of cases; this means that they judge intuitively and mistakenly. The previously mentioned statement is shown in the results. It can be recommended in the period of broad internet use that at least occasional visits to websites of Public Defender of Rights where not only the laic public but the professional public can learn much about discrimination, because the demand for an increase of legal awareness of society is always a neverending process, not only in the sphere of discrimination.

Problematika protiprávního přemístění dětí z místa jejich obvyklého bydliště je v poslední době velmi aktuální vzhledem k narůstajícímu počtu těchto případů. Řešení takového případu je poměrně obtížné a vyžaduje spolupráci celé řady institucí. Signatářské státy Úmluvy o občanskoprávních aspektech mezinárodních únosů dětí mají povinnost si určit tzv. ústřední orgán pro řešení této problematiky. V České republice je jím Úřad pro mezinárodně právní ochranu dětí. Touto oblastí se v České republice zabývá celá řada dalších institucí. Za zmínku stojí nově vytvořený institut styčného soudce, který by měl přispět k lepšímu řešení případů protiprávního přemístění dětí. Důležité postavení v otázkách mezinárodních únosů dětí mají i ostatní orgány sociálně právní ochrany dětí a další subjekty.
Problems of illegal removal of children from the site of their usual residence are recently very topical due to the increasing number of these cases. The solution of this case is rather difficult and calls for a cooperation of a number of institutions. Signatory countries of the Convection on civil aspects of international child abductions are due to establish so called central body for solution of this problem. In the Czech Republic this is the Office for International Legal Protection of Children. A number of further institutions deal with this field of interest in the Czech Republic. The newly established institute of the liaison judge is noteworthy, which should contribute to the solution of cases of the illegal removal of children. The other authorities of the social-legal protection of children and further subjects have also important position in problems of international abductions of children.

Projekt ochrany práv uživatelů drog (POPUD) uskutečnila Liga lidských práv v letech 2003 2004 a jeho cílem byly identifikace, sledování a řešení případů porušování základních lidských práv problémových uživatelů drog bezpečnostními složkami v ČR. V pilotním projektu se podařilo zmapovat situaci v dané oblasti, navázat spolupráci s nízkoprahovými službami (Drop In, SANANIM) a vyzkoušet různé možnosti kontaktování klientů a metody práce s nimi. Příspěvek popisuje jak výsledky monitoringu, tak i praktické zkušenosti s nabízením bezplatné právní pomoci. Ukazuje se, že ke zlepšení problematiky z dlouhodobého hlediska nestačí nabízet pomoc obětem, ale je nutné zvyšovat právní povědomí problémových uživatelů drog a posilovat nezávislou kontrolu nad činností policistů v oblasti dodržování lidských práv.
The Protection of Drug Users‘ Rights Project was carried out by the Czech League of Human Rights in 2003-04. Its objectives consisted of identifying, monitoring, and addressing cases of breaches of the fundamental human rights of problem drug users by members of the Czech police forces. The pilot project succeeded in mapping the situation in the field, starting cooperation with Prague’s low-threshold services, such as the Drop In Centre and SANANIM Contact Centre, and testing various outreach methods. The contribution describes both the results of monitoring and practical experience based on offering free legal aid. In order to improve the human rights situation of problem drug users in the long term, it is necessary not only to offer help to victims but also to raise legal awareness among problem drug users and to promote independent mechanisms of monitoring the police as regards their adherence to human rights.
