Afekty jsou náhlé a rychle začínající a často rychle odeznívající emoční reakce na různé podněty a jsou doprovázeny jak vegetativními, tak i např. mimickými projevy. V rámci afektu často dochází k těm nejzávažnějším trestným činům - vraždám. Ve vyhodnocení zločinů v afektu nepanuje mezi znalci terminologická, ale ani názorová shoda. Autoři se snaží zmapovat snahy o vymezení a pojmenování afektu ještě prostého, nepatického, nicméně velmi silného, který u znalců dlouhodobě vyvolává potřebu forenzně zásadně jej i ohodnotit. Ve shodě s právnickým komentářem se autoři snaží, při vědomí existence nového trestního zákoníku, preferovat rozlišení na afekt prostý a patičky Nedoporučují používání termínů afekt nezvládnutý, či dokonce nezvládnutelný. Současně upozorňují na nutnost dalšího bádání a vymezení afektu ještě prostého, ale již přecházejícího v afekt patičky kdy toto pomezí - hranice, jeho diagnostika, znalecké vyhodnocení, patří bezpochyby k nejobtížnějším úkolům forenzní psychiatrie. Jsou si vědomi, že tento přechod zcela jistě existuje, ale na své znalecké vyhodnocení a terminologické pojmenování dosud čeká. Autoři upozorňují na nutnost dalšího dialogu mezi psychiatry, psychology, ale i právníky, kteří se zločiny v afektu zabývají. Právní komentář odráží aktuální pohled na problematiku zločinů v afektu a je pro psychiatry zásadní, protože již zohledňuje existenci nového trestního zákoníku. Z komentáře je patrné, že i pro odborníky z právní oblasti je problematika zločinů v afektu jednou z těch diskutabilních a obtížně uchopitelných.

Affects are sudden and quickly starting and often rapidly subsiding emotional reactions on different stimulations, accompanied with both vegetative and facial expressions. The affect is often connected with the most serious types of crime - murders. There is no terminological or opinion agreement among experts in affect crimes evaluation. Authors endeavour to chart efforts to define and describe the affect simple, not pathic, but still very strong, which evokes the need of forensically assessing among the experts. In accordance with the juridical commentary, the authors, in the knowledge of the latest penal code, endeavour to prefer distinction between affect simple and pathic. They don't recommend the use of terms affect uncontrolled or even uncontrollable. At the same time they point out the necessity of further research and definition of affect simple, but already in the process transformation into affect pathic, when this frontier - border, its diagnosis, expert evaluation, is undoubtedly on of the most difficult tasks of forensic psychiatry. They are aware that this transition is certainly there, but without any expert evaluation or terminological description yet. The authors highlight the need of further dialogue among psychiatrists, psychologists, but lawyers, who deal with affect crimes, too. Juridical commentary reflects the current view on the issue of affect crime and is for the psychiatrists essential, because it already takes the existence of new Penal Code into account. The comment apparently shows that the issue of affect crimes is a controversial topic even among experts in the juridical area.

Autoři se zabývají zevrubným rozborem článků 13 a 14 Evropské sociální charty (dále „Charta"), které se týkají práva na sociální pomoc a práva využívat sociálních služeb. Značná pozornost je věnována výkladům uvedených článků, které poskytuje ve svých stanoviscích - tzv. Závěrech - Výbor pro sociální práva (dříve Výbor nezávislých expertů). Popsán je i kontrolní mechanismus plnění závazků vyplývající z Charty pro jednotlivé signatářské státy. Autoři dále zmiňují i nedostatky platné právní úpravy sociální péče v České republice a naznačují možné směry dalšího legislativního vývoje v dané oblasti, opět s přihlédnutím k platné úpravě V Chartě a k jejímu výkladu podávanému zmíněným Výborem.

The authors are dealing with a detailed analysis of the articles 13 and 14 European Social Charter (further "Charter") concerning social help right and right to use social services. Considerable attention is paid to the interpretation of the mentioned articles, which provides in its standpoints - so called Findings - Social Rights Commitee (formerly Independent Experts Commitee). The control mechanism of fulfilment of the obligations due to the Charter for each signatory state is described too. The authors further mention deficiency of the valid legal adjustment of social care in the Czech Republic and indicate possible directions of the next legislative development in the mentioned area, again with a respect to the valid adjustment in the Charter and to its interpretation by the mentioned commitee.
