The article “Notes to the New Civil Code” deals with the substantial changes in the field of the civil law as of the January 2014. First it lists the principals of the Code, next it names some of the legal issues referred to the health care. The new Civil Code covers some of the same material scope as the Law on Health Services therefore it is required for any use to consider the relation between the two laws and its particular provisions and subsequently to decide which is to be applied.
Nový občanský zákoník stanovil nová pravidla odškodňování nemateriální újmy na zdraví. Nejvyšší soud ČR připravil Metodiku odškodňování újem na zdraví. Metodika vychází z Mezinárodní klasifikace funkčních schopností, disabilitya zdraví vypracované Světovou zdravotnickou organizací (WHO). Posuzováno bude provádění úkolu poškozenýma zapojení do životní situace. Dvě osoby se stejnou nemocí (MKN) mohou mít rozličný stupeň funkčních schopností (MKF) a dvě osoby se stejným stupněm výkonnosti nemusí mít nezbytně stejné zdravotní problémy. Výchozí rámcová hodnota při pomyslném úplném vyřazení ze společenského života byla vyčíslena na částku okolo 10 mil. Kč.
The new Civil Code sets out new rules for compensation for harm not affecting property (damage to health). The Supreme Court prepared the Methodology of Non-material Damage Compensation. The Methodology is based on the International Classification of Functioning, Disability and Health (a system developed by the World Health Organization). An expert will assess the patient‘s ability to perform a task and their involvement in life situations. Two persons with the same disease (according to ICD) can have a different level of functioning (ICF), and two persons with the same level of functioning do not necessarily have the same health complications. The baseline amount to compensate for hypothetically total social impartment of a sufferer has been set around 10 million Kč.

S účinností od 1. 1. 2013 byla v občanském soudním řádu (dále o. s. ř.) dne 24. 10. 2012 novelizována pasáž o řízení o vyslovení přípustnosti převzetí nebo držení v ústavu zdravotnické péče (§ 191a–§ 191h o. s. ř.), a to zákonem č. 404/2012 Sb. Co je v této novelizaci podstatné a nové pro zdravotnické pracovníky a co musíme změnit v své praxi? Zejména to, že souhlas opatrovníka osoby zbavené nebo omezené ve způsobilosti k právním úkonům nenahrazuje souhlas umístěného. Článek shrnuje i další změny o. s. ř. a vyplývající doporučené změny v psychiatrické praxi. V článku se pracuje s novelizovaným zněním zákona o zdravotních službách, které vstoupilo v účinnost dne 14. 3. 2013.
With effect from 1 January 2013, the section in the Code of Civil Procedure (CCP) on the proceedings on the grant of permission to accept or detain a person in a health care institution (Article 191a to Article 191h of the CCP) was amended by Act No. 404/2012 Coll. What in this amendment is relevant and new for health care professionals and what has to be changed in their practice? In particular, it is the fact that the consent of the guardian of a person deprived of or restricted in their legal capacity does not replace the consent of the institutionalized person. The article also summarizes additional changes in the CCP and the resulting recommended changes in psychiatric practice. The article deals with the amended Act on Health Services that has become effective on March 14, 2013.

In the past three years, the Czech Republic has made far-reaching interferences in the legal regulation of socio-legal protection of children. In particular, children's rights have been strengthened, and new legal means assisting their protection have been established. With the adoption of new legal regulation of family law (which is comprehensively regulated by the Civil Code Act No. 89/2012 Coll.), a new procedural regulation has also followed, which deals with procedural ordinances connected with the protection of minor children, and a new act on special court procedures has been adopted. This extensive legal regulation has been a reaction to the elevated need of child protection, the necessity of which was evident in the periodical evaluations of the reports on the implementation of the Convention on Children's Rights in the Czech Republic. The increased children's rights protection, including the participatory right, was implemented in the new legislation, which became binding on 1 January, 2014. The purpose of this paper is to define the implementation of the children's participatory right into the new legal regulation in the Czech legal code, with a focus on the connection between such legal regulations, regarding the socio-legal children's rights protection authority (SLCRPA), and the courts in civil procedures, with respect to the differing roles and positions of the SLCRPA and courts in guaranteeing child protection. We have carried out a comparative analysis of legal texts from the point of view of implementation of international documents. The examined home legislation included the Act No. 359/1999 Coll., on Socio-Legal Child Protection, Act No. 89/2012 Coll., the Civil Code, Act No. 99/1963 Coll., the Civil Proceedings Code, Act No. 292/2013 Coll., on Special Court Procedures and the practical impact of such legislative regulation.

It is obvious that n ew civil code provides very far reaching changes for the healthcare providers and their patients. Civil code presents completely new type of contract – treatment contract. This regulation w as influenced especially by DCFR and Dutch civil code. But due to historical reasons it is not completely clear if this new type of the contract is applicable without exceptions in all relationship s between healthcare provider s and patient s or there are al so other types of contracts which are ap p licable. The aim of this article is to provide guidelines for this determination of different types of contractual relationship . This determination of the contracts is very important for establishment of rights and duties of contractual parties, their potential liability and other remedies .
