Autorka uvádí stručný popis nevýhod dosavadního systému nemocenského pojištění. Cílem sdělení je seznámení se s návrhemvěcného záměru nového zákona o nemocenském pojištění. Návrh doporučuje v zákoně uvést definice základních pojmů –pracovní neschopnost, stabilizovaný zdravotní stav, novou možnost posuzovat PN po 180 dnech jejího trvání v obecné rovině,nikoliv pouze k dosavadnímu zaměstnání, všechna práva a povinnosti ošetřujících upravit zákonem. Návrh obsahuje i sankcepři opakovaném neplnění povinností ze strany ošetřujícího lékaře.

The author presents a brief description of disadvantages of a current system of health insurance. The objective of thepresentation is the introduction of the draft of the new law on health insurance. It is proposed to include definitions of basicterms –working incapacity,stabilized health status into the law.According to the draft, it is possible to assessworking incapacityat a general level not only in relation to current employment after 180 days duration. The draft further presents all rights andduties of physicians in attendance which should be covered by the law. The draft also includes sanctions when duties are notfulfilled by the physician in attendance repeatedly.

Lékařská posudková činnost vykonávaná pro účely sociálního zabezpečení a zaměstnanosti je nedílnou součástí léčebně preventivní péče. Orgány sociálního zabezpečení (Česká správa sociálního zabezpečení, Ministerstvo práce a sociálních věcí) nebo zaměstnanosti (úřady práce) vydávají – prostřednictvím svých lékařů nebo posudkových komisí – na základě posouzení zdravotního stavu fyzických osob posudky.Tato lékařská posudková činnost má svá pravidla a specifika, a to jak v oblasti systému lékařských prohlídek, zjišťování zdravotního stavu, objektivizace funkčních poruch, prokazování posudkově rozhodných skutečností, tak i náležitostí posudku.

Medical assessment activities undertaken for the purposes of social security and employment are the inherent part of the medical and preventive care. Authorities of social security (Czech administration of social security, Ministry of labour and social issues) or employment (offices for work) issue expert evidence of the assessment of health status of individuals by means of their physicians reviewers or review committees. The medical assessment activity has its rules and specificities in the system of medical examinations, assessment of health status, objectivization of functional disorders, proving decisive evidence and requirements for the expert evidence.
